1. Service Description

ProtestMax ("Service"), operated by Ownerly ("we," "us," or "our"), is an AI-powered document preparation and guidance platform that helps property owners prepare protest packets for property tax assessments. The Service analyzes public records, comparable sales data, and user-provided information to generate protest documents, evidence packages, and filing guides.

2. User Responsibilities

By using ProtestMax, you represent and agree that:

• You are the property owner or an authorized representative of the property owner.
• All information you provide is accurate and complete to the best of your knowledge.
• You will verify all data, figures, and documents generated by the Service before submitting them to any government agency or using them in any proceeding.
• You are solely responsible for the accuracy and completeness of any filing you make.
• You understand that filing a protest based on inaccurate information may have consequences under applicable law.

3. Payment Terms

• Pricing: The Service costs a one-time fee of $45 per property protest packet. There are no recurring charges, subscriptions, or percentage-based fees.
• Payment Processing: Payments are processed securely through Stripe. We do not store your full credit card information on our servers.
• Money-Back Guarantee: We offer a 30-day money-back guarantee from the date of purchase. If you are unsatisfied for any reason, contact us at team@ownerly.xyz within 30 days for a full refund.
• No Hidden Fees: You keep 100% of any tax savings achieved through your protest. We do not charge contingency fees or take a percentage of your savings.

4. Data Accuracy & AI-Generated Content

The Service uses artificial intelligence (including Google Gemini and Anthropic Claude) to analyze public records, comparable sales, and property data. You acknowledge and agree that:

• AI-generated analysis and documents may contain errors, inaccuracies, or omissions.
• Property valuations, comparable sales data, and savings estimates are approximations and should not be relied upon as definitive assessments.
• Public records data may be outdated, incomplete, or incorrect.
• You are responsible for reviewing and verifying all generated content before use.
• Estimated savings are projections only and do not guarantee any particular outcome.

5. No Guarantee of Outcomes

ProtestMax does not guarantee that your property tax protest will be successful or that you will achieve any particular reduction in your property tax assessment. Protest outcomes depend on many factors outside our control, including local appraisal district policies, hearing officer discretion, market conditions, and the specific facts of your property. Past results for other users do not guarantee future results.

6. State-Specific Warnings

Property tax protest rules, deadlines, and requirements vary by state and jurisdiction. You are responsible for understanding and complying with your local requirements.

7. Intellectual Property

All content, design, software, algorithms, and materials on the ProtestMax platform are owned by Ownerly and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform or its content without prior written consent.

Documents generated for your property protest are licensed to you for personal use in connection with your property tax protest. You may not resell, redistribute, or commercially exploit generated documents.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• In no event shall Ownerly, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service ($45).

9. Indemnification

You agree to indemnify, defend, and hold harmless Ownerly and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your filing of any documents generated by the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Travis County, Texas.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
